Article 1 - Applicability

Dans les présentes conditions générales, les définitions suivantes s’appliquent :

  • o Seller: “Insensum” / VZW Incense & Fragrance, Bovenhoek 14b, 9185 Wachtebeke, Belgium / VAT: BE 0780.765.272
  • o Buyer: any natural or legal person who places an order by e-mail, on the website, by telephone or in Insensum’s warehouse.
  • o Product(s): the subject of one or more agreements, goods and/or services.

Article 2 - Conditions Conditions

2.1. Our general terms and conditions apply to all offers made by the seller.

2.2. If additional special conditions apply in addition to these general conditions, the above provisions also apply to these special conditions.

2.3. Placing an order on the website, by e-mail, by telephone or in the shop constitutes express acceptance of our general terms and conditions of sale, which are always available on the website: https://www.insensum.be.

Article 3 - Products

3.1 If an offer has a limited period of validity or is subject to certain conditions, we will expressly state this in our offer.

3.2 All our olfactory products are handmade. Consequently, there may be differences from one delivery to the next, among others, in terms of fragrance and the hardness and length of the incense grains. 

Article 4 - Order

4.1 Your order is complete and will only be processed once payment has been received.

4.2. Pour acheter un produit sur notre site web, ajoutez le produit à votre panier. Saisissez ensuite vos coordonnées et vos informations de facturation. Choisissez ensuite le mode de livraison. Vous acceptez ensuite nos conditions générales et confirmez votre commande en cliquant sur le bouton « Valider la commande ». Votre achat est alors définitif. Si vous avez choisi de payer par carte bancaire, vous serez dirigé vers le portail de paiement de Mollie.com. Si vous avez choisi de payer par PayPal, vous serez dirigé vers le site Paypal.com. Vous recevrez une confirmation de votre paiement par e-mail de la part du portail de paiement concerné. Si vous avez choisi de payer par virement bancaire, vous recevrez une confirmation d’insensum.be dès que votre paiement aura été crédité sur notre compte.

Article 5 - Right of withdrawal

5.1. The right of withdrawal only applies if you reside in a country in the European Economic Area.

5.2. When you purchase products from us online, you have the right, for a period of 14 days from delivery of the products, to decide not to keep them. Please inform us by email at shop@insensum.be. If you meet the conditions for returning goods, we will send you instructions on how to proceed.

5.3. Within 30 days of acceptance of the return, Insensum will refund the sums paid.

5.4. Goods returned must not have been used or reduced in quantity (incense grains). If you return the goods, you must do so in the original packaging, with all the accessories supplied, in their original condition and in accordance with our instructions.

5.5. The cost of returning the goods shall be borne by the purchaser. 

Article 6 - Prices

6.1. The prices indicated on our website are in euros and include all taxes, VAT, duties and services, unless otherwise indicated, but exclude shipping costs.

6.2. Shipping costs are calculated automatically for each single order by the Bpack World web application (www.bpost.be). Insensum reserves the right to adjust the shipping costs upwards or downwards if inaccuracies are found in the calculation. Insensum will inform you by e-mail.

6.3. All prices indicated on the site are subject to printing and composition errors. We accept no liability for the consequences of technical and printing errors.

6.4 Insensum reserves the right to modify the prices of the products offered on its website at any time and to correct any prices indicated in error.

Article 7 - Payment

7.1 Insensum accepts the following means of payment: Bancontact/Mister Cash, iDeal, Visa, MasterCard, Maestro, Paypal, European bank transfer (IBAN: BE35 9734 2440 4437, in favour of VZW Incense and Fragrance).

7.2. Online transactions are processed by Mollie BV and/or Paypal. 

Article 8 - Conformity and guarantee

8.1. Insensum guarantees that the product delivered complies with the agreement and meets the specifications set out in the offer.

8.2. All products purchased in the warehouse must be checked before purchase. They are not guaranteed after purchase and cannot be returned or exchanged. 

Article 9 - Delivery and performance (only applicable to orders placed via the online shop)

9.1. All goods and services will be delivered to the address you provide when you place your order.

9.2. If an item is in stock, it will be offered to the carrier within 1 to 5 working days of receipt of payment.

9.3. Any complaint concerning visible damage to the packaging of the goods delivered must, in order to be taken into account, be made in writing on the accompanying documents at the time of delivery by the carrier.

9.4 Insensum shall not be liable for any consequential loss due to late delivery or non-delivery, damage or loss by our appointed carrier.

5.5. The cost of returning the goods shall be borne by the purchaser.

Article 10 - Force majeure

10.1. In the event of force majeure, Insensum is not obliged to fulfil its obligations. In this case, either the obligations may be suspended for the duration of the force majeure, or the contract may be definitively terminated.

10.2. Force majeure is any circumstance beyond Insensum’s control that prevents the performance of all or part of its obligations. This includes strikes, fire, operating breakdowns, power failures, breakdowns in the (telecommunication) network or in the connection or communication systems used and/or the unavailability of the website at any time, non-delivery or late delivery by suppliers or other third parties that have been called in.

Article 11 - Intellectual property

11.1. Insensum’s website, logos, texts, images and names are protected by intellectual property rights.

11.2 It is forbidden to use and/or modify the intellectual property rights described in this article without the prior and express written consent of Insensum.

Article 13 - Disclaimer

13.1 Insensum cannot be held responsible for the incorrect use of its products.

13.2 Insensum shall not be liable for damage caused directly or indirectly after delivery, for any reason whatsoever, to the Buyer, the Buyer’s property, the Buyer or members of the Buyer’s family, third parties or third parties’ property.

13.3 All information on the website and in Insensum’s workshop/warehouse has been originally produced by Insensum or obtained by Insensum. Insensum is not responsible for incorrect or incomplete data or any other information appearing via or through this site. These data are purely informative and are in no way binding.

13.4. By accepting the conditions of purchase, the user confirms that he/she has read this disclaimer.

Article 14 - Complaints procedure and disputes

14.1 Any complaint must be made within eight days of the delivery or invoice date. It must be made by registered letter and must be justified. In the absence of a dispute within the time limit set, the invoice is deemed to have been accepted.

14.2. You can contact Insensum at https://insensum.be/en/#contact. Insensum will endeavour to deal with your complaint within 7 working days.

14.3. All contracts concluded by Insensum with its clients, regardless of their place of residence, are governed exclusively by Belgian law and, in the event of a dispute that cannot be settled amicably, only the Commercial Court of Ghent (Gent) has jurisdiction.

Disclaimer of liability

Insensum endeavours to ensure that the information on its website is accurate, but cannot exclude the possibility that it may contain incomplete information or errors.

Information is entered manually, which can sometimes lead to errors.

Insensum accepts no liability in this respect.
